Terms of Sales
1. DEFINITIONS:
Gift voucher: means the electronic voucher sent to the Customer allowing him to obtain the Service Provision ordered on the Site www.nikaiaglisse.com.
Customer: means the person who orders the service or Gift Voucher either for himself or for a third party and who pays the price of the Service.
Service: refers to the service provided on www.mandelieu-loisirs.com.
Nikaia Watersport: refers to the company Nikaia watersport operator of the mark.
Website: refers to the website www.nikaiaglisse.com
End User or Beneficiary: refers to the User who uses the Voucher, whether or not he is the Client.
Partner: Company distributing one or more activities of the company Nikaia Watersport (Cap adrenaline, Sport discovery …)
2. ACCEPTANCE OF TERMS OF SALE – CAPACITY OF THE PARTIES:
These general conditions of sale apply to any order of service on the website www.nikaiaglisse.com in the form of a purchase for oneself or a gift voucher on the Services performed on the Site and may be supplemented by particular conditions appearing on the Site. They can be modified without notice and only the general conditions of sale on line on the day of the order apply. The Customer acknowledges having read it prior to his order and have accepted. He can download or print them when ordering or at any other time.
Nikaia Watersport Partners may have their own terms and conditions of sale or services relating to the performance of the Ordered Service. Nikaia Watersport can not under any circumstances be held responsible for any lack of information on any of the offers published on the website of one of its partners when it comes to specific general or specific terms and conditions. Partner. The Customer is obliged to verify with the Partners the legal and obligatory information and conditions required regarding the ordered Service.
The Client acknowledges having the capacity to contract, that is to say to be of age according to the legal provisions of his Country of nationality and not to be the subject of a measure of curatorship, guardianship or safeguard of justice which would restrict his ability to contract.
The Customer further acknowledges having the physical abilities necessary to perform the service he orders and is informed that a medical certificate may, according to the Service ordered, be requested by the Service Provider. In the event that he can not provide this certificate, the Service Provider will be entitled to refuse to provide the Service and this refusal may not result in any refund. These provisions are also valid for the End User of the Gift Voucher, the Customer having to ensure prior to the order that his physical condition allows him to perform the Service.
Nikaia Watersport makes every effort to ensure the descriptions are as accurate as possible and to update them in real time. Any error or omission in the writing of the descriptions would be purely involuntary and could not result in the liability of Nikaia Watersport.
The descriptive, visual or video associated with these Services have no contractual value.
The offers are valid as long as they are available online on the website, subject to availability.
In the event of unavailability of an activity, the beneficiary agrees to modify its reservation date according to the availability of the partner.
4. PRICE:
The prices of the Services for sale on the Website are indicated in euros and all taxes included. The description of the service offered on the website nikaia watersport www.nikaiaglisse.com specify the elements included in the price.
The selling price of gift vouchers does not include any shipping costs charged in addition to the price when the Gift Voucher can not be delivered electronically.
Prices may be changed at any time without notice. The price of the Services is invoiced on the basis of the tariff in force at the time of the validation of the order.
In order to prevent the beneficiary from adding a supplement to carry out his activity, the value of the gift voucher will correspond to the maximum price of the activity for the period regardless of a price change during the year from the partner.
5. ORDER:
Orders are exclusively placed on the website www.nikaiaglisse.com by following the procedure and instructions contained therein. The Customer must be particularly vigilant when entering his contact information and address. Any mistake on his part can not lead to the responsibility of Nikaia Watersport and whatever the consequences.
For reasons beyond our control or extraordinary or safety-related circumstances
or extraordinary circumstances or relating to the security of persons certain Services may be modified. These changes will be brought to your attention if you have already booked the relevant Benefit and you will then have the possibility, either to accept the modification, or to request a credit of an amount equal to the value of the Voucher and usable exclusively on the website www.nikaiawatersport.com.
As part of a Gift Voucher for a Benefit determined on a date reserved by the beneficiary, if regardless of our will (weather conditions), the service is no longer available on the scheduled date or if, Nikaia Watersport was no longer in the ability to offer the benefit then the date of validity of the gift voucher would be extended.
6. PAYMENT OF PURCHASES:
The validation of the order by the Customer obliges him to make the payment. The customer will be charged the value of the service at the time of validation of his order.
Nikaia Watersport will be credited with the amount immediately as part of the purchase of a service or a gift voucher valid for the current season The payment of the price is made only by paypal or by credit card on the secure interface of payment of the Website www.nikaiawatersport.com.
Accepted credit cards are: CARD BLUE, VISAS to the exclusion of all others.
The Customer must ensure that his spending limit is sufficient at the time of order. He can reach his bank branch by telephone to raise this ceiling if it is insufficient.
Nikaia Watersport has put in place a verification procedure for the identity of the Cardholder used to pay the order. As part of this verification procedure, the Customer may be required to provide a copy of his identity documents.
In case of refusal of payment by the authorization center or the verification service, the order is canceled. The payment involves the sending to the Customer of an email summary of his order accompanied by a printable invoice and the electronic gift voucher to be printed and delivered by hand to the beneficiary.
In case of reservation subject to confirmation procedure within 72 hours (Article 11 below) the request for payment is the subject of a request for authorization.
7. EXCHANGE BONDS:
Depending on the case, a Gift Voucher will be provided to the Client after payment if the latter chooses this option when selecting the following service:
A voucher for a given benefit valid for the current season.
A gift voucher of a fixed value and valid on all services offered on the Site at the time of its use, subject to availability on the date chosen at the time of booking, during the duration of the current season as of its program.
8. CONDITIONS FOR USING GOODS:
1 – The voucher is valid for the current season from the moment the service provider is open for a defined period, that is from May 15th to September 30th. In no case may they be used with another Partner or for another Service or on any other date, except as provided in Article 11 below.
The expiry date is indicated on the Gift Voucher.
2 – Nikaia Watersport may, in certain cases, ask the customer to send them the e-voucher to confirm their reservation. The Gift Voucher must imperatively be given to Nikaia Watersport the day it carries out its activity. The gift voucher serves as a payment and can only be used once.
3 – All the Services are proposed according to the availabilities. Nikaia Watersport can not be held responsible for any unavailability on the chosen date. It is advisable to book as early as possible or 48 hours in advance depending on the activities chosen by the client to benefit from a wide range of dates.
4 – No cancellation or postponement of reservation will be accepted without the direct agreement of Nikaia Watersport.
5 – The service does not include transportation to the meeting point at Nikaia Watersport.
6 – Certain activities are accessible only according to certain conditions (physical, meteorological, seasonal (sports of slips or nautical) or others). These conditions are indicated for each activity on the website www.nikaiawatersport.com. Nikaia Watersport reserves the right to refuse the requested Service or to postpone the reservation if the required conditions are not met.
7 – The beneficiary of the purchase will be able to contact NIkaia Watersport directly for the addition of any additional services, according to the conditions of this one.
9. RIGHT OF WITHDRAWAL:
Implementation of the right of withdrawal:
Under the conditions set out in Article L.121-20 of the Consumer Code, the Customer has a withdrawal period of 7 (seven) clear days from the date of purchase on the website www.nikaiaglisse. com. Any exercise of the right of withdrawal must be reported in advance to Nikaia Watersport, by mail to yvan.nws@sfr.fr or by mail to Nikaia Watersport, 4 boulevard de Cimiez “Le Majestic” 06000 Nice When this period expires on a Saturday, a Sunday or a holiday or holiday, it is extended until the next working day.
Exclusion of the right of withdrawal
It is however expressly reminded that according to the article L. 121-20-4 of the Code of the consumption, the Customer will not be able to exercise its right of retraction concerning the Services of leisures which must be provided on a date or according to a specific periodicity. They will therefore not be reimbursed, the said Services being in any case designated as such to Customers, before the conclusion of the sale.
10. TERMS OF EXTENSION:
Only unused Gift Certificates and Gift Certificates with an expired validity period may be subject to a renewal of the validity period:
Throughout the validity period of the Bond,
Within the limit of 9 months after the expiry date of the Bond.
11. BOOKING:
The reservation is unavailable on the website www.nikaiaglisse.com. It will be done by phone only on 06 18 58 18 82 or 06 09 16 02 16. The following activities are subject to reservation: flyboard, parasailing. Other activities are not subject to reservation: water skiing, wakeboard, paddle, flyfish, buoys
The contact details are posted on the nikaia watersport website in the “Booking” tab of the offers or on its homepage.
Nikaia Watersporte is in charge of confirming your reservation directly according to its availability.
Nikaia Watersport can not be held responsible for the limited or unavailable dates in case of non respect of these conditions.

14. REFUNDS:
In case of right open to reimbursement to the benefit of the Customer, refunds made to the Customer will be made by paypal or check within a maximum period of thirty days from the day the right to reimbursement will be acquired and will not give rise to interest s’ it is done within this time.
15. RESPONSIBILITY:
It is recalled that Nikaia Watersport acts as a leisure provider.
The responsibility of Nikaia Watersport can not be held liable for non-performance of the activity beyond the validity period of the offer.
16. PROTECTIONS OF PERSONAL INFORMATION AND COOKIES:
In accordance with the Data Protection Act of 6 January 1978 as amended by Law No. 2004-801 of 6 August 2004, the Customer has the right to oppose the processing by Nikaia Watersport of his personal data, a right of access, modification, rectification and deletion of personal data concerning him. In particular, he has the right to question Nikaia Watersport with a view to obtaining confirmation that his personal data are or are not being processed, information relating to the purposes of the processing, the categories to which they are are communicated.
A copy of the personal data concerning him can be issued to him, at his request and against reimbursement of the production costs thereof.
However, Nikaia Watersport has the opportunity to oppose manifestly abusive requests, in particular by their number, their repetitive or systematic nature.

17. APPLICABLE LAW – DISPUTES:
The mandate agreement concluded between the Customer and Nikaia Watersport and the sale concluded between the Client and the Partner are subject to French law. All claims must be made in writing to Nikaia Watersport with supporting documents.
